$10 Million Maryland Wrongful Death Lawsuit Blames Baltimore County Police for Taser Fatality

The family of Ryan Meyers is suing Baltimore County police and three cops for Maryland wrongful death. They are seeking $10 million in compensation and alleging negligence and police brutality.

Meyers is bipolar. The 40-year-old died after cops, who arrived at his parents' home following a 911 call, tasered him. Meyers had been allegedly using a baseball bat to attack people, and his father was injured.

According to the officers, they tasered him because he ignored their order to put down the bat. Meyers went down but then got up and allegedly tried to attack them. They managed to handcuff him and then saw that he was unresponsive. He went into cardiac arrest and was pronounced dead at the hospital.

Meyer’s family believes that the police officers could have used less force to apprehend him.

Taser Injuries
According to one study published in 2006 by the American College of Cardiology Foundation, even though getting struck by a Taser won’t likely cause cardiac arrest, it is recommended that Taser darts not be fired close to the heart. Seeing as this study was funded by Taser International, the manufacturer has known about this possible risk from some time.

Another man, Steven Butler, went into immediate cardiac arrest after he was tasered by cops. EMT’s were able to revive him, but his brain didn't get oxygen for such a long time that he is now permanently disabled. He and his family are suing Taser International for products liability.

In the last six years, there have been 8 Maryland taser deaths involving police. The stun gun shoots about 50,000 volts of electricity into the skin and is considered a less lethal alternative to shooting someone. However, medical experts say that getting struck near the chest by a Taser dart can make the target’s heartbeat go from 72 beats per minute to up to 220 beats a minute.

Meantime, Taser maintains that its electronic control device is safe for use.

Baltimore, Maryland Truck Accident Lawsuit Seeks $5 Million for Family of Bicyclist

The family of John R. “Jack” Yates is suing a truck driver and his employer for the 67-year-old’s Baltimore wrongful death. Yates was cycling in the Charles North neighborhood on Maryland Avenue behind the truck driven by Michael Dale Chandler on August 4 when he got trapped under the loaded fuel tanker’s tires and was run over.

The truck kept going because Chandler does not appear to have realized that he had driven over anyone. Yates was pronounced dead at the crash site.

Now, Yates’ daughter and wife are suing the truck driver and Potts & Callahan Inc. for $5 million. Following an investigation into the Baltimore truck crash, the bicyclist was found responsible for the tragic accident since he was riding in the parking lane and tried to overtake the truck from the right. However, the plaintiffs’ legal team is adamant that Yates wasn’t at fault. Under Maryland law, bicyclists must keep up with the flow of traffic and make sure their bicycles stay to the right.

Chandler has not been criminally charged over the Maryland truck collision.

Maryland Truck Crashes
It is devastating to know that someone you loved died in a tragic accident. Not only must surviving family members cope with losing someone they love and the effects that this unexpected, premature death will have on their lives, but there is also the trauma of imagining what your loved one may have had to endure prior to death. For bicyclists that survive large truck crashes, they may be left to struggle with traumatic brain injuries, spinal cord injuries, burn injuries, or disfigurement.

Even if a negligent motorist isn’t charged in criminal court, you can sue them for the Maryland wrongful death of your loved one in civil court.

Maryland Semi-Truck Crash Kills Husband and Seriously Injures His Wife

A Harford, Maryland tractor-trailer crash has killed one man while critically injuring his wife. Leonard Clark, 38, and his wife Kimberly, 39, were standing next to I-95 on the night of February 24 when they where hit by a semi-truck.

The seriously injured couple was transported to Maryland Shock Trauma Center where Leonard was pronounced dead. As of last Friday, Kimberly’s condition was considered very serious.

Our Maryland tractor-trailer crash attorneys extend our sympathies to the Clark family. Losing someone you love and/or getting seriously hurt in a semi-truck crash is catastrophic. Tractor-trailers are so huge in size and heavy and weight that anyone struck by a semi-truck is at high risk of sustaining serious injuries and/or dying.

Just the day before the Maryland truck accident involving the Clarks, 22-year-old Boonsboro pedestrian Anthony Allen McChesney died when he was hit by a United Parcel Service semi-truck on I-81. The Hagerstown truck crash occurred at around 4:31 am.

Also last month, during the early afternoon of February 11, a State Highway Administration worker got hurt when a tractor-trailer hit his truck as he warned motorists that a crew was removing snow off the Baltimore Beltway. The SHA worker, James Flutka, sustained injuries. Truck driver Robert Scolaro, who was transporting diapers, was not injured. He did receive a traffic citation for failure to control speed.

Choking Hazards: US Pediatricians Seek to Prevent Injuries to Children By Asking for Warning Labels

The American Academy of Pediatrics says that its time that the US government mandate that warning labels be placed on the packaging of foods that pose a potential choking hazard to children. The pediatricians’ group also is calling for a redesign of certain manufactured foods, such as candies and hot dogs, which can be reshaped in a manner that is safer for kids.

Dr. Gary Smith, the head of the group’s Committee on Injury, Violence, and Poison Prevention, says that foods that are round or cylindrical in shape are a choking hazard. Smith noted that there are steps that can be taken to protect kids from choking, which is considered the number one cause of death in the five and under age group and the reason that thousands of kids under age 15 end up in the emergency room. One study reports that hot dogs are a factor in 17% of the asphyxiation accidents involving food and kids in the 10 and under age group.

Some other choking accident food culprits include:

•	Peanuts
•	Marshmallows
•	Meat chunk
•	Cheese chunks
•	Peanut butter

At least one child fatality every five days is caused by a food-related choking accident. For a boy or girl who is lucky enough to survive an accidental choking incident, if the brain was deprived of oxygen for long enough, there may be the possibility of a traumatic brain injury.

Maryland Lawmakers Want Texting While Driving Ban to Block Drivers From Reading Messages

Maryland lawmakers are planning on making read text messages while driving illegal. The current texting while driving ban, which went into effect last year, only bans drivers from sending text messages. There also may be enough support to ban the use of hand-held cell phones while driving, especially as the newer phones include applications that allow drivers to e-mail, Facebook, Twitter, and browse the Internet. Currently, school bus drivers and drivers with provisional licenses and learner’s instructional permits are not allowed to talk on any kind of cell phone while operating a motor vehicle. Lawmakers, however, want to do more to decrease the number of Maryland car accidents.

According to the Harvard Center of Risk Analysis, about 636,000 auto crashes a year involved someone using a cell phone. 2,600 fatalities and 330,000 injuries have resulted from these distracted driving accidents. The National Safety Council says that the number of car crashes caused by cell phone (talking and texting) use—1.6 million auto collisions—is even higher. Meantime, the Insurance Institute for Highway Safety and the Highway Loss Data Institute have reported that the number of car crashes in states with handheld cell phone bans doesn’t seem to have gone down.

The Maryland General Assembly has struggled with how much restriction to place on cell phone driving activities. However, there is no longer any doubt that texting while driving increases a motorist’s Maryland motor vehicle accident risk dramatically. While the act of texting is harmless in and of itself, it is the fact that motorists become distracted, taking their eyes and mind off the road and their hands off the steering wheel, that makes texting while driving such a dangerous driving activity. People have even compared its degree of dangerousness to the perils presented by driving while drunk.

Just this week, a jury convicted a man of killing a pedestrian while he was engaged in distracted driving. Prosecutors claim that he was texting.

In most cases, the distracted driver never intends to hurt anyone. Yet unfortunately, Maryland personal injuries and wrongful deaths do happen.

Baltimore City Jury Awards Brooke Greenberg $250,000 for Maryland Personal Injuries in Medical Malpractice Lawsuit Against Johns Hopkins Hospital

A Maryland jury has awarded Brooke Greenberg $250,000 for Baltimore medical malpractice injuries she sustained while at Johns Hopkins Children's Center after she underwent a medical procedure to replace her feeding tube in 2007. The Reisterstown teenager is known internationally for never aging past infancy, despite the fact that she is 17-years-old.

After she was discharged from the hospital, her home nurse and parents noticed that there were bruises on her legs and arms. Her parents sued for Maryland medical malpractice involving injuries to a minor on her behalf.

Last week, a Baltimore city jury found the famous hospital in breach of the standard of care when Greenberg was inappropriately restrained after the surgery. They awarded her damages for the emotional trauma and physical pain she suffered.

The hospital is debating whether to appeal the jury verdict. Hospital officials claim that Greenberg was suffering from a disorder that caused spontaneous bruising. However, the jury determined otherwise.

Greenberg has never developed past infancy. Scientists are trying to determine the cause of her mysterious condition.

Hospitals are supposed to provide each patient with the standard of care. Failure to meet that standard of care or deviating from that standard can be cause for filing a Maryland personal injury or wrongful death lawsuit if the patient gets hurt, suffers emotional trauma, or dies.

Medication mixups, poor sanitation, surgical errors, inappropriate restraints, wrong diagnosis, delayed diagnosis, anesthesia errors, nursing negligence, failure to check vitals, and failure to do follow-ups following procedures are some of the reasons why people have sued for Maryland medical malpractice.

Rep John Murtha Dies Surgical Complications After Doctors “Hit His Intestines”

What should have been a routine laparoscopic surgery has proved fatal for Rep. John Murtha of Pennsylvania. The 77-year-old died from complications when doctors “hit his intestines” during the minimally invasive gallbladder procedure at National Naval Medical Center in Bethesda. His intestine was damaged and an infection developed.

Murtha has been the Pennsylvania’s 12th Congressional District Representative since 1974 and was number eight in the chamber in terms of seniority. He was the first Vietnam War veteran elected to the US Congress. In 2005, he shocked Washington when he called for the US to withdraw from Iraq.

Murtha leaves behind his wife and three children.

Maryland Surgical Malpractice
If doctors made a medical mistake that caused Murtha’s health complications, the congressman’s family may have grounds for filing a Maryland medical malpractice lawsuit against the hospital and the medical professionals involved in the gallbladder surgery.

Laparascopic gallbladder surgery
Laparascopic gallbladder surgery involves the removal of the gallbladder without having to open the abdominal cavity. During this minimally invasive procedure, a small incision is made and a trocar is inserted. A video camera and small surgical tools are inserted using the trocar so the surgery can be conducted. Surgeons can watch the surgery on a monitor that airs what the video camera inside the body is recording.

It is important that a surgeon cut or clip in the right places in order to safely remove the gallbladder. Cutting the wrong anatomical part can cause serious injury or death. Other serious side effects include bile peritonitis, bile leakage, abscess, cholangitis, and infection.

Surgeons can be held liable for Maryland surgical malpractice if their medical mistake, carelessness, or recklessness causes personal injury or wrongful death to a patient.

Maryland Police Say Frederick County Car Accident Caused by Teen on Cell Phone

A 17-year-old driver is accused of causing a serious Frederick County, Maryland car accident while talking on a cell phone on Wednesday. The young driver was merging onto Interstate 70 when he allegedly rear-ended a 1999 Jeep Cherokee driven by Norman Hayter, Jr., a Middletown resident. Police say that the juvenile did not realize that road work had caused traffic to slow down.

Hayter, 58, was seriously injured in the Maryland auto accident. He was transported by air to Washington County Hospital.

Meantime, the teen driver sustained minor injuries. He is charged with negligent driving.

Distracted Driving
Teen drivers, who are more easily distracted and less experienced than their older motorist counterparts, are already at greater risk of being involved in a motor vehicle collision. Add the additional distraction of talking on a phone or texting while driving, and the consequences can prove fatal.

In Maryland, drivers younger than age 18 with a provisional or a learner driver’s license are prohibited from using any kind of cell phone while driving. All other motorists are allowed to drive and use a cell phone at the same time. Sending text messages while driving in Maryland is banned.

Although it now has been confirmed that talking on any kind of cell phone is dangerous—there is no US state that completely bans this distracted driving habit and there are only six US states that ban the use of handheld cell phones—it is impossible to ignore the fact that at least 1.6 million US motor vehicle accidents a year are caused by texting and cell phone using drivers.

If a motorist causes a car accident while talking on a cell phone, he or she can be charged with negligent driving, and injury victims may choose to file a lawsuit for Maryland personal injury or a wrongful death.

Harford County and Its Sheriff’s Office are Defendants in $145 Million Maryland Wrongful Death Lawsuit Alleging Police Brutality

The family of Dwight Jerome Madison is suing Harford County and the Harford County Sheriff's Office for Maryland wrongful death. Madison, 48, died after police threw him in jail last June. His family is alleging wrongful arrest and police brutality. They are seeking $145 million from the defendants.

According to the Maryland police brutality lawsuit, Madison was arrested on June 11, 2009 just hours after police stopped him in Bel Air. The 48-year-old was let go after he told them he was looking for a friend in the area. Police officer followed him and arrested him for trespassing. He was transported to the Harford County Detention Center.

Police claim that Madison asked to be arrested so he would have some place to go. They then contend that while in custody, he became uncooperative and grabbed and choked one of the guards. Police TASERed Madison, who fell and struck his head.

The Maryland wrongful death lawsuit claims that the following day, a civilian jail worker and three corrections officers assaulted Madison, who had a severe head injury. Even though it was allegedly obvious to those involved that Madison was dying, they continued to Taser him, causing his death. Madison died at Maryland Shock Trauma Center in Baltimore on June 13.

The family’s wrongful death lawsuit, filed in U.S. District Court in Baltimore, says the corrections employees and deputies directly caused his wrongful death and violated his legal rights. It also alleges that the defendants have consistently engaged in “condoning its officers’ pervasive misconduct and abuse of authority.”

Arresting someone without just cause and using excessive force to detain them are both possible grounds for suing the police for Maryland personal injury.

Even if you did break the law, police must still uphold your civil rights. Unfortunately, many people are too scared to speak out for fear of repercussions.

State's Board of Public Works Approves $1.5 Million Lutherville Train Accident Settlement in Maryland Wrongful Death of Two Teenagers

Maryland’s Board of Public Works has given the green light to a $1.5 million Baltimore County wrongful death settlement over the fatal train accident that killed two teenagers last year. Kyle Patrick Wankmiller and Jarrett Connor Peterson were walking along tracks that are usually used by trains headed southbound in Lutherville on July 5 when a northbound train hit the two 17-year-olds. The Maryland Transit Administration had switched the direction of traffic on the tracks.

Following the deadly Maryland train collision, the MTA said the two teens had their backs to the trains when they were hit from behind. A spokesperson says the two boys thought the train was using the other track as it approached them. The public is not allowed to be on the tracks unless they are at designated crossing areas.

The train’s operator reportedly did not notice that the train had hit the two boys and did not stop. The operator of a second train that later passed through also failed to see the teenagers. It wasn’t until a third train came through that a fare inspector saw their severely injured bodies.

Two train operators were fired and six other workers were disciplined over the tragic Baltimore County train accident. No criminal charges were filed over the deadly incident.

The families’ Maryland injury attorney notified the state that they planned to sue. A Baltimore County wrongful death settlement was reached before the families filed their lawsuit. The lawyer noted that even though state law prevents plaintiffs who contributed to their personal injury from recovering damages, the Maryland’s wrongful death law has a provision that holds responsible the party that has the “last clear chance” of preventing an injury accident from happening.

Maryland Train Accident Injuries to Pedestrians
Pedestrians that are struck by trains will likely have sustained serious have sustained serious injuries that require medical attention as soon as possible. Train operators must exercise caution that they don’t accidentally strike someone or, if they do, that they get that person medical help right away. Some common causes of train accidents include mechanical failure, operator error, inadequate maintenance, and speeding.

Maryland TBI: Call a Concussion a Mild Traumatic Brain Injury, Says Researchers

A team of researchers are recommending that concussions should be called mild traumatic brain injuries so that this type of condition is taken more seriously. The team is concerned that many people don’t think of a concussion as an injury to the brain.

The researchers looked at the medical records of 300 children with traumatic brain injuries who were treated at McMaster Children’s Hospital in Canada. 102 of them were diagnosed with having a concussion. 385 of the kids diagnosed with a concussion actually had a mild TBI, while 24% in fact had a serious or moderate TBI.

According to Professor Carol DeMatteo of the CanChild Centre for Childhood Disability Research at McMaster University, in each case involving a child diagnosed with a concussion, the patient and their parents did not think the injury was serious. DeMatteo says this can be a problem.

According to the study’s findings, kids that were diagnosed with having concussion diagnosis spent less time in the hospital than children who were diagnosed with a mild brain injury. They also went back to school and resumed playing sports sooner than kids diagnosed with more serious brain injuries.

DeMatteo notes that if a child isn’t given enough time to recover, more concussions may occur and the risk of permanent brain damage increases.

Brain Injuries to Children
Brain injury is one of the most common causes of death and disability to young children. If your son or daughter suffers an injury to the head, it is important that you get medical help right away. What may appear to be a mild injury to the head may actually be a brain injury.

If your child sustained a TBI in a car crash, fall accident on another person’s property, or another kind of injury accident, you may have grounds for filing a Maryland traumatic brain injury lawsuit involving injuries to minors.

Maryland Medical Malpractice?: 369 Patients May Have Received Unnecessary Stents

Following an internal review, a Towson hospital has notified 369 patients that stents may have been unnecessarily implanted in their arteries. St. Joseph Medical Center conducted the probe after a number of patients complained and at the request of federal investigators. The hospital is under investigation for health-care fraud.

According to the Baltimore Sun, there were patients at St. Joseph who underwent the procedure even though the blockage in their arteries was minor. For example, one man who received a stent only had 10% blockage, but the hospital told him that the blockage was 95%. Another woman was wrongly diagnosed with a heart condition and received a stent because she was told her arteries had a 90% blockage. In fact, the blockage was no more than 10%.

Cardiac Catheterization
Coronary stents are used to open up clogged arteries or create a bridge where there is damage. Stents are usually implanted during cardiac catheterization. During this medical procedure, the device can be implanted into the arteries through the leg and via the bloodstream. Cardiac catheterization can be costly, and many insurers, as well as Medicare, require that an artery must have at least 70% blockage before a stent can be inserted. Although generally a safe procedure, serious health complications, such as infection, bleeding, blood vessel damage, allergic reaction, blood clots, heart attack, stroke, arrhythmias, low blood pressure, and kidney damage, can occur.

If you were wrongly diagnosed with an illness or health condition, were advised to undergo a medical procedure you did not need, were given the wrong medication, or if a medical mistake occurred during treatment, you may have grounds for filing a Maryland medical malpractice lawsuit against those responsible.

Undergoing any type of medical procedure can take a physical and emotional toll on a patient. There is no reason to undergo an unnecessary procedures that can place your life at risk, take an emotional and physical toll on you, and require time off for recovery.

Baltimore Man Sues Anne Arundel County Police Department and Officer for False Arrest

A 38-year-old Baltimore man has filed a civil rights violation lawsuit accusing Anne Arundel County police of violating his civil rights when they arrested and imprisoned him without just case. Melvin B. Thomas says he was falsely arrested on January 17 for asking “What about freedom of the press?” after officers apprehended his friend for using a cell phone to videotape cops handcuffing spectators following a Glen Burnie boxing event when some people became rowdy.

Thomas says he and his friend, 32-year-old Pasadena resident Leshon C. Ruffin, were the only two people who were thrown in jail where he stayed for 12 hours. Now, he is seeking $30,000 in damages.

Cpl. Russell Hewitt III, who is a defendant in the Maryland false arrest lawsuit, claims in charging documents that Ruffin was apprehended for trying to approach officers while they were doing their job. He says he arrested Thomas because he was causing a disturbance with his yelling.

Thomas’s attorney, however, says that Thomas and Ruffin were behaving in a nondisruptive manner while others around them were shouting out profanities. All charges against the two men were dropped. Thomas has said that because he and his friend are black he thinks race was a factor. Two white people that also were handcuffed were released at the scene.

Thomas's Maryland civil rights violation lawsuit is seeking $30,000 in damages.

Maryland False Arrest Lawsuit
A police officer who has violated a person’s civil rights can be sued for damages. Making false arrests, wrongful imprisonment, excessive use of force, verbal abuse, harassment, torture, intimidating tactics, and sexual assaulting a suspect or prisoner can be grounds for a civil lawsuit against the offending police officer, his/her police department, and possibly even the city or the county where the violation took place.

You don’t have to be afraid about coming forward if you were the victim of Maryland police brutality or were falsely arrested without just cause.

$1.2 Million Maryland Wrongful Death Settlement Reached with Family of Teen Restrained at Carroll County, Reform School

The family of Isaiah Simmons III has reached a $1.2 million Maryland wrongful death settlement with Bowling Brook Preparatory School and the state's Department of Juvenile Services. The Maryland teen died in 2007 after he was restrained at the reform school.

Simmons’ family had accused counselors of holding him face down and sitting on him for about three hours. Simmons, a Baltimore 17-year-old, eventually lost consciousness and stopped breathing. The counselors are accused of waiting 41 minutes after Simmons became unresponsive to contact 911. Simmons was pronounced dead at Carroll Hospital Center. Following the tragic incident, Bowling Brook maintained that its staff followed appropriate procedures and denied that workers knelt or sat on Simmons’ head or torso.

Per the school's report, on January 23, 2007, a staff member questioned Simmons about threats he allegedly made. The teenager allegedly made more threats and at around 4:45 pm, staff members and students restrained him. An ambulance was called at about 8:15 pm.

A school staff member told a 911 dispatcher that the restraint methods the counselors used on Simmons were not unusual. The employee said that the school had dealt with other aggressive kids in similar fashion.

Student eyewitnesses claim that five staffers were sitting on Simmons. One student says Simmons told them he couldn’t breathe and that he was in pain but the counselors didn’t believe him.

The reform school was eventually shut down. It reopened last year under new management. The school is now called Silver Oak Academy.

The $1.2 million Baltimore wrongful death settlement is the maximum allowed under Maryland personal injury law.

Nine-Year-Old Boy Dies from Injuries Sustained from Falling Tree at the Hashawha Environmental Center in Westminster, Maryland

Noah Asid, the 9-year-old who was injured on December 29 when a large hickory tree fell on him at the Hashawha Environmental Center has died at a Baltimore hospital. Asid, who was attending a nature camp, was getting ready to go hiking with a group of children and counselors when the tragic accident happened.

According to reports, the 60-foot tree fell against a maple tree. This caused the maple branches to give way and the hickory and a number of large branches to hit the ground, striking Asid and another child. The girl, 10, has been released from Carroll Hospital Center.

The Carroll County sheriff’s office is determining what caused the tree to fall. Winds hitting speeds of up to 35 mph on the day of the accident may have been a factor.

Falling Tree Accidents
Falling tree accidents are not as uncommon as they sound and can cause catastrophic injuries to children and adults. Trees in parks, public areas, and other places frequented by children and other members of the public must be properly maintained so that they don’t pose a premise liability. If a property owner or overseer could (and should have) been taken to prevent the premises liability accident from happening, the victim or surviving family members can sue for Maryland personal injury or wrongful death.

Just last year, a 30-year-old man died after he was hit by a tree branch that fell in New York’s Central Park. In December, a wrongful death settlement was reached with the family of a woman who died after a tree fell on the car that she and her daughter were riding. The tree’s decaying root system contributed to its fall.
